GENERAL TERMS AND CONDITIONS OF CONTRACT
1. Scope
The following general terms and conditions of CLÍNICA MARTÍNEZ CANUT (hereinafter referred to as “CANUT“ or “The Holder“) apply to your order in the version valid at the time of making your purchase or contracting the service.
The terms and conditions apply exclusively to contracts made through the Internet portal and will comply with the provisions of current legislation, particularly Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

3. Object
These general terms and conditions of contract (hereinafter, the “Conditions“) regulate the purchases and the performance of tests offered through the CANUT website, as well as the rights and obligations of the parties arising from the service provision operations agreed between them, specifically the purchase and performance of tests offered on the website.
4. Registration on the Website by Users/Clients
Registration on the website must be carried out by individuals of legal age. By creating a Customer or User account, or by contracting any service, the User agrees to be responsible for the data submitted and the services offered, which must not be offensive or contradict applicable law.
This information must be kept up to date, and the User must ensure the security of their Customer/User account and access credentials, being solely responsible for activities carried out through their account.
The User will not use another person's account, impersonate someone else, or provide false information through their account to deceive. Any of these behaviors will authorize the Holder to cancel their account, without prejudice to taking legal action as deemed appropriate.
Any unauthorized use of the account must be immediately reported to CANUT by the User.
5. Service Contracting
The completion of a purchase or the contracting of a service through the CANUT website implies the acceptance by the Customer/User of all the conditions stipulated in this document.
When the Customer/User purchases a product or contracts a service, and reaches an agreement with CANUT, the price and conditions will be indicated in advance before making any payment.
For any clarification, complaint, or if any issue arises related to your service, the Customer/User can contact the Holder at the email address contact@perioproject.com.
6. Contracting Process
6.1. Purchase Process
CANUT makes packages of tests available for purchase through the website. To do this, the user must be registered and logged into their customer or user account.
Once the user has selected the products they want to purchase, they will appear in the shopping cart. After completing the purchase process, they can access the summary of their order to confirm and finalize the purchase.
Once the user has made an online purchase on the CANUT website, they will receive a purchase confirmation with all the details, the contract, fees, cancellation policy, and any other relevant information via the email provided.
To purchase products offered by CANUT, the fields with the required data must be filled out, and these Terms and Conditions must be accepted. This acceptance will mean express, full, and unconditional agreement with all the general conditions set out in the version published by CANUT, binding both parties.
CANUT will ensure that all services offered have legal coverage, quality guarantees, and, if necessary, the corresponding insurance.
To make payments for services, CANUT may use external providers such as payment gateways and other transaction processors. Each one has its own conditions and policies. All transactions will be carried out through secure payment platforms with complete confidentiality of your data. Specifically, CANUT will use the Stripe platform.
7. Prices
The price of products/services is the one indicated at each moment on the website.
The prices displayed include VAT or the corresponding tax depending on the territory.
In this regard, the tests that the user can purchase are included in different packages, with a different price depending on the selected package, as follows:
- Packages of five (5) tests: 35 euros.
- Packages of ten (10) tests: 60 euros.
- Packages of twenty (20) tests: 100 euros.
8. Price Errors
If an error in the price is detected after the purchase by the Customer, CANUT must notify the Customer of the issue as soon as possible, inform them of the incident, and offer the option of cancellation or maintenance under the correct conditions.
The automatic confirmation does not validate incorrect price conditions. In the case of cancellation, any amount paid by the Customer will be refunded.
The final price will be the one in force in the advertisement coinciding with the time of formalizing the purchase, without prejudice to any updates that may occur.
The Holder makes every effort within its means to provide accurate information without typographical errors on its website.
9. Other Expenses
If there are additional expenses for the service, they will be communicated to the Customer and itemized in the final price prior to payment for the service.
10. Right of Withdrawal
The consumer has the right to withdraw from the contract within a period of 14 calendar days without justification. The right of withdrawal allows the Customer to return what has been contracted without the need to justify their decision. The consumer has a period of fourteen (14) calendar days from the day following the start of the service provision.
The right of withdrawal will not be applicable in the following cases:
- Sealed goods that are not suitable for return for reasons of health or hygiene and that have been unsealed after delivery.
- When the nature of the goods or service prevents the contract from being undone.
- Provision of services fully performed with the express consent of the consumer.
- Goods that, after delivery and due to their nature, have been inseparably mixed with other goods.
- Goods made to the consumer's specifications or clearly personalized.
- Goods that may deteriorate or expire rapidly.
To exercise the right of withdrawal, you must notify CLÍNICA MARTÍNEZ CANUT, S.L.P., at our postal address Calle Chile, 12, Bajo – 46021, Valencia (SPAIN), as well as at the email address contact@perioproject.com of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail, fax, or email). You may use the withdrawal form model below, although its use is not mandatory.
If you let this period elapse but during the course of the agreed contract you wish to terminate it and request a refund, the right of withdrawal will not apply.
You also have the option to electronically complete and submit the withdrawal form model or any other unequivocal statement through the website. If you choose this option, we will promptly communicate the receipt of such withdrawal on a durable medium (for example, by email).
To meet the withdrawal deadline, it is sufficient that the communication regarding the exercise of this right is sent before the corresponding period expires.
Consequences of Withdrawal:
In the event of withdrawal by Users, the full amount will not be refunded, but the amount corresponding to the tests not performed by the user will be refunded, if applicable.
Therefore, the amount and method of payment refund during the term of the contract, in case of resolution or non-compliance, will be paid as agreed by the parties, without this refund having to be made obligatory through the website.
CANUT reserves the right to reject requests for returns or cancellations communicated or sent outside the specified period.
Withdrawal must meet all these conditions to be accepted.
11. Duration of the Contract
The duration of the contract will be subject to the duration agreement established by the parties, although generally, it will extend to the period between the purchase of the tests and their performance.
12. User Obligations
All Customers or Users of CANUT must make proper use of our website, being solely responsible for any damages that may be caused to CANUT or third parties due to their lack of diligence or malicious actions.
Through these conditions, the Customer/User is responsible for the truthfulness and accuracy of the data and information provided as a result of the online service contract.
CANUT reserves the right to restrict or deny the provision of a service to the Customer/User in the event that it becomes aware that the Customer/User has violated the hiring conditions, the general conditions of the website's use, the privacy policy, as well as any other particular condition that may be agreed upon.
13. Disclaimer
CANUT will not be responsible for the misuse carried out by Customers/Users registered on the website. In this regard, damages caused to third parties of any kind will not be the responsibility of CANUT.
CANUT will not be liable in situations beyond its control, such as strikes, natural disasters, or technical failures, which may cause failures or malfunctions on the website.
CANUT is also not responsible for any illegal activities that may be carried out through the website, and Customers must respect the rules established by CANUT.
14. Industrial and Intellectual Property
The products or services provided through our website are subject to copyright. In addition, those logos, trademarks, texts, icons, and other content subject to industrial and intellectual property rights are protected by current and applicable laws. The Holder has obtained authorization from the rights holder to use this content or material.
15. Conflict Resolution
For conflicts that may arise between the Customer/User and CANUT as a result of a breach of the hiring conditions, they will be governed by the provisions of current legislation, and the rules of the Spanish legal system will apply.
If any of these terms is considered null or unenforceable, such provision will be deemed not to be in effect and will not affect the validity of the remaining provisions.
